I think the answer depends on just how mature and responsible this girl is. You've already set it straight that you like this girl. Yet this girl is in an awkward relationship where she is off and on with this guy. The situation itself is definitely giving off a red flag and you need to tread carefully if you're looking to start a relationship with this girl. Unless she gets to the point where she gets over her ex completely, things could get really messy.
